  • You are responsible for ensuring that project requirements, assets, and approvals you provide are lawful and accurate.
  • Service requests submitted through our forms are handled for agency offerings such as design, development, SEO, branding/marketing, app, and AI chatbot services.
  • We may contact you regarding proposals, timelines, deliverables, and service-related updates.
  • We may decline or stop servicing a request if submitted information is misleading, abusive, unlawful, or creates operational/security risk.

4. Client Materials

“Client Materials” include content, text, logos, brand assets, images, credentials, documentation, and other inputs you provide for service delivery. You retain ownership of your Client Materials.

By providing Client Materials, you grant Brand Wings a non-exclusive, worldwide, royalty-free license to use, reproduce, and process those materials solely to provide, maintain, and improve the requested services, and to comply with legal obligations.

You represent and warrant that you have all rights necessary to provide Client Materials and that such materials do not violate law or infringe third-party rights.

5. Acceptable Use

  • Use the Service for lawful purposes only.
  • Do not harass, threaten, abuse, or harm other users, or encourage others to do so.
  • Do not upload or share content that is illegal, defamatory, hateful, sexually exploitative, or otherwise harmful.
  • Do not upload content that infringes intellectual property or privacy rights of others.
  • Do not attempt to access, probe, or disrupt the Service, systems, or networks without authorization.
  • Do not use bots, scrapers, or automated tools to access the Service in a way that burdens or interferes with normal operation.

7. Subscriptions & Payments

The Service may include paid project work, retainers, consultations, or other digital services. Pricing, scope, milestones, and delivery timelines are defined in proposals, invoices, or service agreements shared with you.

Unless otherwise stated in writing, fees are non-refundable for completed work or consumed service time, except where required by applicable law. If you believe a charge is incorrect, please contact us promptly at info@brandwings.online.

We may update pricing or offerings over time. Any changes apply prospectively and do not retroactively change agreed terms for already-approved work.

8. Disclaimer

Brand Wings provides professional digital services and information on an "as available" and "as is" basis.

While we apply commercially reasonable efforts and industry best practices, we do not guarantee specific business results such as rankings, lead volume, conversion rates, revenue outcomes, or uninterrupted availability of third-party platforms.

9. Limitation of Liability

To the maximum extent permitted by law, Brand Wings and its directors, officers, employees, partners, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.

In any event, to the maximum extent permitted by law, Brand Wings total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to Brand Wings for the Service in the 12 months preceding the event giving rise to the claim (or USD $100 if you have not made any payments).

10. Termination

You may stop using the website at any time. For active projects, termination rights and obligations are governed by the specific proposal, invoice terms, or written agreement.

We may suspend or terminate access to our Service or decline project continuation where we reasonably believe there is a breach of these Terms, non-payment, unlawful conduct, or material operational risk.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
